Terms and conditions

1. Applicability:
These are the general terms and conditions that apply to all orders placed through our online shop by consumers and businesses.

These terms and conditions also apply to future business relationships with businesses, without the need for us to specifically refer to them. If the business uses terms and conditions that conflict with or supplement these general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to them.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity. A business is a natural or legal person or a legal partnership with the capacity to enter into a legal transaction in the course of its commercial or independent professional activity.

2. Contractual Partner, Conclusion of Contract
The purchase contract is concluded with mezzo-forte String Instruments, Owner Dr. Jörg Kleinalstede. The presentation of products in the online shop is not a legally binding offer, but rather a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. By clicking the order button, you place a binding order for the goods in the shopping cart. The confirmation of receipt of your order is sent by email immediately after the order is placed.

The timing of when the contract with us is concluded depends on the payment method you have chosen:

Invoice, Credit Card
We accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within two days.

Advance Payment
We accept your order by sending a declaration of acceptance in a separate email within two days, in which we provide you with our bank details.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. There, you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

3. Language of the Contract, Storage of the Contract Text
The languages available for concluding the contract are German and English. We store the contract text and send you the order data by email.

4. Delivery Conditions
In addition to the stated product prices, shipping costs will be added. Further details on shipping costs and delivery terms can be found on our website.

We only deliver goods by shipment. Unfortunately, it is not possible to collect the goods yourself.

We do not deliver to packing stations.

5. Payment
The following payment methods are generally available in our online shop:

Credit card
When you place your order, you provide your credit card details, and your card is charged when the order is completed.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your login details, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.

6. Reservation of Title
The goods remain our property until full payment is made.

For businesses, the following also applies:

We reserve ownership of the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign all claims arising from this resale to us in advance - regardless of connecting or mixing the reserved goods with a new item - in the amount of the invoice, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.

7. Warranty and Guarantees
The statutory warranty rights apply. Information on any additional guarantees and their precise conditions can be found with the product and on special information pages in the online shop.

8. Liability
We are always liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents

in case of injury to life, body, or health,
in the event of intentional or grossly negligent breach of duty,
in the case of guarantees, if agreed, or
to the extent that the scope of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, the liability is limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
